1. Acceptance of Terms

By accessing or using AnnounceFlow ("the Service"), operated by Sabai Innovations, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether through the Shopify App Store or our website.

2. Description of Service

AnnounceFlow is a Shopify application that allows merchants to create and display customizable announcement bars on their online stores. The Service includes:

• Announcement bar creation and customization tools
• Multiple bar types including promotional, countdown timer, free shipping progress, email capture, and cookie consent bars
• Live preview functionality
• Analytics and reporting features
• Email subscriber management (Premium plan)

3. Account Registration

To use AnnounceFlow, you must have an active Shopify store and install the app through the Shopify App Store. By installing the app, you authorize us to access certain store data necessary to provide the Service.

You are responsible for maintaining the security of your Shopify account and any activities that occur under your account.

4. User Obligations

When using our Service, you agree to:

• Provide accurate and complete information
• Use the Service only for lawful purposes
• Not use the Service to send spam, misleading content, or malicious code
• Comply with all applicable laws, including privacy and data protection regulations
• Not attempt to interfere with or disrupt the Service
• Not reverse engineer or attempt to extract source code from the Service

You are solely responsible for the content displayed in your announcement bars. Content that violates laws, promotes illegal activities, or infringes on third-party rights is prohibited.

5. Payment Terms

AnnounceFlow offers both free and premium subscription plans. Payment is processed through Shopify Billing:

• Free Plan: No charge, includes limited features as described on our pricing page
• Premium Plan: Monthly subscription fee as displayed at the time of purchase

Subscription fees are billed through your Shopify account. By subscribing, you authorize Shopify to charge the applicable fees to your payment method on file.

Cancellation: You may cancel your subscription at any time through the Shopify admin. Cancellation takes effect at the end of your current billing period.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Sabai Innovations and are protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you create using the Service, including announcement bar text, images, and configurations. By using the Service, you grant us a limited license to display your content as necessary to provide the Service.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

7. Limitation of Liability

To the maximum extent permitted by law, Sabai Innovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data
• Loss of business opportunities
• Business interruption

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

9. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:

• Modify or discontinue features with or without notice
• Perform maintenance that may temporarily affect availability
• Update the Service to improve functionality or security

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent or abusive behavior
• Non-payment of subscription fees

Upon termination, your right to use the Service will cease immediately. Any data associated with your account may be deleted according to our data retention policies.

11. Indemnification

You agree to indemnify and hold harmless Sabai Innovations, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated revision date.

For significant changes, we will provide notice through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through good faith negotiation or, if necessary, through binding arbitration.
